1. Scope
These terms apply to the “DeepSwing” mobile app by Deep Platforms GmbH (“we”). By installing or using the app you agree to these terms.
2. App services
DeepSwing analyzes golf swing videos on‑device and provides angles, phase scoring, and coaching hints. We also offer an optional Community area where registered users can post videos, watch a feed, comment, like and reply. Community videos are streamed from our servers.
- Only videos you actively share are uploaded. Unshared videos remain local.
- History videos can be exported; Community videos are not exportable.
AI notice (EU AI Act): Analysis/coaching hints and the support chat may be generated in whole or in part by AI (if enabled). Outputs are informational and may be incomplete or inaccurate. No automated decisions with legal or similarly significant effects are made. You can request human support at any time (see Contact).
The app does not replace professional coaching or medical advice.
3. Registration & community access
- The Community is optional but requires an account.
- Sign‑in is available via Apple, Google, or email & password.
- You must accept the current Terms and Privacy Policy.
- You are responsible for accurate information and for keeping credentials secure.
- We may suspend or close accounts in case of abuse, violations or security risks.
4. Minimum age
The Community is intended for users aged 16 and above. If we learn of prohibited use, we may suspend the account and remove content.
5. User content & community rules
Community content (videos, captions, comments, replies) is visible to other users. Do not share sensitive or confidential information.
- No illegal, hateful, harassing, pornographic or violent content.
- No infringement of third‑party rights (privacy, copyright, trademarks).
- No identifiable persons without their consent.
- No spam, advertising, deception, automated mass uploads or scraping.
- No malware, phishing links or security threats.
6. Content license
You retain ownership of your content. By uploading, you grant us a non‑exclusive, worldwide, royalty‑free license to host, store, technically process (e.g., compression/transcoding) and display your content within the Community. This license ends when the content is deleted; technical backups may persist for a limited time.
7. Reporting & moderation
Users can report content. Reports are sent to info@deepswing.io and reviewed by us. We may remove content, restrict visibility, limit features, or suspend accounts that violate these rules.
8. Uploads, retention & deletion
- Community uploads are stored on our servers and streamed for playback.
- Posts are currently deleted automatically after 14 days, including related comments, likes and notifications.
- You can request earlier deletion (see Contact).
- Local copies on your device are not affected.
9. Delete account
You can delete your Community account in the app (Settings > Community Account > Delete account). We will remove your account, posts, comments, likes and notifications. Technical backups may persist for a limited time. You may also request deletion by email.
10. Subscriptions, pricing, cancellation
- Optional Pro features are offered exclusively via Apple in‑app purchases (subscriptions). Prices and terms are shown in the App Store.
- Manage/cancel via Apple ID subscriptions: apps.apple.com/account/subscriptions.
- Access ends after the paid period if you cancel.
11. Warranty and liability
- We provide the app with reasonable care on an “as is” basis; availability and specific results are not guaranteed.
- We are fully liable for intent, gross negligence, and injury to life, body, or health. Otherwise, liability is limited to typical, foreseeable damages.
12. Intellectual property
The app, content, logos, and brands are protected by copyright and trademark law. Any use beyond legal allowances requires our prior written consent.
13. Privacy
See our Privacy Policy for details. The app is designed for on‑device processing and data minimization; Community features require server processing.
14. Changes
We may adjust these terms for functional or legal reasons. We will inform you of material changes in the app. The current version is available on this page.
15. Governing law and venue
German law applies (excluding UN CISG). Where legally permitted, venue is Munich, Germany.
